La Cour d\u2019appel de Paris devait statuer sur la validit\u00e9 de la marque verbale RENT A CAR sur renvoi apr\u00e8s cassation.<br \/>\n&nbsp;<\/p>\n<p>L\u2019absence de distinctivit\u00e9 intrins\u00e8que est assez logiquement confirm\u00e9e car \u00ab les termes &#8216;car&#8217;, &#8216;a&#8217;, &#8216;rent&#8217; appartiennent au vocabulaire de base en anglais et sont, \u00e0 ce titre, enseign\u00e9s aux \u00e9l\u00e8ves d\u00e8s les premiers mois d&#8217;apprentissage \u00bb.<br \/>\n&nbsp;<\/p>\n<p>L\u2019acquisition du caract\u00e8re distinctif par l\u2019usage est refus\u00e9e par la Cour qui rel\u00e8ve que l\u2019usage de la marque avec le logo ne permet pas l\u2019acquisition de la distinctivit\u00e9 de la marque verbale : \u00ab la soci\u00e9t\u00e9 RENT A CAR ne d\u00e9montre pas que, malgr\u00e9 l&#8217;usage intensif qu&#8217;elle fait de sa marque semi-figurative englobant sa marque verbale, cette marque verbale est devenue apte, dans l&#8217;esprit du consommateur moyen de la cat\u00e9gorie des produits en cause, normalement inform\u00e9 et raisonnablement attentif et avis\u00e9, \u00e0 identifier les produits et services d\u00e9sign\u00e9s \u00e0 son enregistrement comme provenant de la soci\u00e9t\u00e9 RENT A CAR \u00bb<br \/>\n&nbsp;<\/p>\n<p><a href=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Image-Rent-a-car.png\"><img decoding=\"async\" loading=\"lazy\" class=\"alignnone size-full wp-image-635\" src=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Image-Rent-a-car.png\" alt=\"Image Rent a car\" width=\"232\" height=\"218\" \/><\/a><br \/>\n&nbsp;<\/p>\n<p><strong>Bataille de bassets devant l\u2019EUIPO (EUIPO, 5 f\u00e9vrier 2019)<\/strong><br \/>\n&nbsp;<\/p>\n<p>Le titulaire de la marque semi-figurative Jo &amp; Mr. Joe (avec deux bassets) s\u2019opposait \u00e0 une marque repr\u00e9sentant un basset pour des produits identiques en classes 18 et 25.<br \/>\n&nbsp;<\/p>\n<p>Assez logiquement, le risque de confusion est \u00e9cart\u00e9 compte tenu des nombreuses diff\u00e9rences visuelles et intellectuelles :<br \/>\n&nbsp;<\/p>\n<p>\u00ab Whilst oral communication in respect of the product and the trade mark is not excluded, the choice of the item of clothing is generally made visually. Therefore, the visual perception of the marks in question will generally take place prior to purchase. Accordingly the visual aspect plays a greater role in the global assessment of the likelihood of confusion. Therefore, the considerable visual differences between the signs caused by verbal and figurative elements are particularly relevant when assessing the likelihood of confusion between them. Therefore as mentioned the above, the few similarities between the signs are not enough to counteract the differences between them\u201d<br \/>\n&nbsp;<\/p>\n<p>Une marque ne peut en effet pas prot\u00e9ger un concept !<br \/>\n&nbsp;<\/p>\n<p><a href=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Image-chiens.png\"><img decoding=\"async\" loading=\"lazy\" class=\"alignnone size-medium wp-image-636\" src=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Image-chiens.png\" alt=\"Image chiens\" width=\"300\" height=\"153\" \/><\/a><br \/>\n&nbsp;<\/p>\n<p><strong>De gros nuages pour L\u2019AURORE prot\u00e9g\u00e9e pour des vins (CA Paris, 29 janvier 2019)<\/strong><br \/>\n&nbsp;<\/p>\n<p>Le titulaire de deux marques semi-figuratives L\u2019AURORE pour d\u00e9signer des vins a assign\u00e9 en contrefa\u00e7on la soci\u00e9t\u00e9 commercialisant un vin sous \u00e9tiquette L\u2019AURORE DE GASCOGNE (avec la signature Bernard Magrez).<br \/>\n&nbsp;<\/p>\n<p>Se montrant tr\u00e8s stricte dans l\u2019appr\u00e9ciation du risque de confusion, la Cour d\u2019appel \u00e9carte toute contrefa\u00e7on en relevant que \u00ab si le signe second comprend dans sa partie verbale le terme &#8216;L&#8217;AURORE&#8217;, il diff\u00e8re totalement des marques premi\u00e8res pour le surplus, d&#8217;abord par sa partie verbale qui comprend en outre le terme &#8216;en Gascogne&#8217; et la signature &#8216;Bernard Magrez&#8217;, ensuite et surtout par sa partie figurative, comprenant des photographies de paysages sombres et automnaux, en opposition \u00e0 des dessins de levers de soleil gais et lumineux \u00bb.<br \/>\nM\u00eame si le terme L\u2019AURORE est tr\u00e8s distinctif pour des vins, la Cour fait ici une appr\u00e9ciation tr\u00e8s circonstanci\u00e9e en donnant une importance aux \u00e9l\u00e9ment figuratifs par rapport aux \u00e9l\u00e9ments verbaux, ce qui est assez rare.<br \/>\n&nbsp;<\/p>\n<p><a href=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Image-AUrore.png\"><img decoding=\"async\" loading=\"lazy\" class=\"alignnone size-medium wp-image-638\" src=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Image-AUrore.png\" alt=\"Image AUrore\" width=\"300\" height=\"162\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p><strong>La vie est Belge : l\u2019exploitation de la marque pour un bar ne vaut pas pour des boissons (EUIPO, 5 f\u00e9vrier 2019)<\/strong><br \/>\n&nbsp;<\/p>\n<p>Cette marque d\u00e9pos\u00e9e en classe 33 (boissons alcooliques \u00e0 l\u2019exception des bi\u00e8res) et en 43 (bars) a fait l\u2019objet d\u2019une action en d\u00e9ch\u00e9ance pour non-exploitation en classe 33.<br \/>\n&nbsp;<\/p>\n<p>Conform\u00e9ment aux principes en la mati\u00e8re, l\u2019exploitation doit \u00eatre appr\u00e9ci\u00e9e en fonction de chaque produit ou service d\u00e9pos\u00e9, et une exploitation pour des produits ou services ne s\u2019\u00e9tend pas aux produits ou services similaires.<br \/>\n&nbsp;<\/p>\n<p>Ici, la marque \u00e9tait exploit\u00e9e pour un bar mais le titulaire est d\u00e9chu de ses droits pour les boissons. En particulier, il n\u2019a pas \u00e9t\u00e9 d\u00e9montr\u00e9 \u00ab qu\u2019il existerait un usage particulier sur le march\u00e9 des boissons alcoolis\u00e9es selon lequel les consommateurs associeraient le nom de l\u2019\u00e9tablissement \u00e0 la boisson qu\u2019ils consomment dans ledit \u00e9tablissement d\u00e8s lors qu\u2019il s\u2019agirait de pr\u00e9parations originales \u00bb.<br \/>\n&nbsp;<\/p>\n<p><a href=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/La-vie-est-belge.jpg\"><img decoding=\"async\" loading=\"lazy\" class=\"alignnone size-medium wp-image-637\" src=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/La-vie-est-belge.jpg\" alt=\"La vie est belge\" width=\"300\" height=\"300\" \/><\/a><br \/>\n&nbsp;<\/p>\n<p><strong>Sarah Connor ? Non, la marque TERMINATOR est d\u00e9chue (EUIPO, 12 f\u00e9vrier 2019)<\/strong><br \/>\n&nbsp;<\/p>\n<p>Apr\u00e8s BIG MAC en janvier, c\u2019est la marque TERMINATOR qui est d\u00e9chue en int\u00e9gralit\u00e9 pour non-exploitation. L\u2019analyse des nombreuses preuves d\u2019usage n\u2019a pas convaincu l\u2019EUIPO qui a consid\u00e9r\u00e9 qu\u2019il ne s\u2019agissait pas d\u2019usage \u00e0 titre de marque, c\u2019est \u00e0 dire pour identifier l\u2019origine commerciale des produits.<br \/>\n&nbsp;<\/p>\n<p>Le passage suivant est particuli\u00e8rement int\u00e9ressant sur la diff\u00e9rence entre un titre de film (prot\u00e9geable par droit d\u2019auteur) et une marque :<br \/>\n&nbsp;<\/p>\n<p>An important distinction has to be made between title and trade mark. The same sign may be protected as an original creative work by copyright and as an indicator of commercial origin by trade mark law. It is therefore a matter of different exclusive rights based on distinct qualities, that is to say the original nature of a creation, on the one hand, and the ability of a sign to distinguish the commercial origin of the goods and services, on the other.
