En r\u00e9alit\u00e9, elle est \u00e9galement obligatoirement due en cas de <strong>d\u00e9mission<\/strong>.<br \/>\n<!--more--><\/p>\n<p>En l\u2019esp\u00e8ce, une salari\u00e9e ayant d\u00e9missionn\u00e9 n\u2019a re\u00e7u aucune attestation P\u00f4le Emploi de la part de son employeur. Elle a r\u00e9clam\u00e9 de ce fait des <strong>dommages-int\u00e9r\u00eats<\/strong> pour non d\u00e9livrance des documents de fin de contrat.<\/p>\n<p>Cassant l\u2019arr\u00eat de la Cour d\u2019Appel pour laquelle <em>\u00ab\u00a0la d\u00e9livrance d\u2019une attestation P\u00f4le Emploi ne s\u2019imposait pas, la salari\u00e9e ne pouvant pr\u00e9tendre au paiement d\u2019allocations ch\u00f4mage du fait de sa d\u00e9mission\u00a0\u00bb, <\/em>la Cour de Cassation a au contraire consid\u00e9r\u00e9 que <em>\u00ab\u00a0cette obligation de d\u00e9livrance s\u2019applique \u00e0 tous les cas d\u2019expiration ou de rupture du contrat de travail.\u00a0\u00bb<\/em><\/p>\n<p>Cette solution se justifie par le fait que ce n\u2019est pas \u00e0 l\u2019employeur de pr\u00e9juger des conditions d\u2019obtention d\u2019assurance ch\u00f4mage de ses salari\u00e9s, d\u2019autant plus que <a href=\"http:\/\/www.pole-emploi.fr\/candidat\/salarie-demissionnaire-@\/article.jspz?id=60559\" target=\"_blank\" rel=\"noopener noreferrer\">certaines d\u00e9missions<\/a> ouvrent droit \u00e0 cette assurance.<\/p>\n<h3>La Cour de Cassation confirme donc l&#8217;obligation pour l\u2019employeur de remettre l\u2019attestation P\u00f4le emploi en cas de d\u00e9mission.<strong><br \/>\n<\/strong><\/h3>\n<p>&#8212;<\/p>\n<p>Par AGIL&#8217;IT \u2013 <a class=\"mailto-link\" href=\"https:\/\/www.agilit.law\/expertises\/droit-du-travail-securite-sociale\/\">Droit du Travail et de la S\u00e9curit\u00e9 Sociale<\/a><br \/>\n<a class=\"mailto-link\" href=\"https:\/\/www.agilit.law\/cabinet\/equipe\/sandrine-henrion\/\">Sandrine Henrion<\/a>, Avocate Associ\u00e9e<br \/>\n<span id=\"eeb-529305\">Alexia Bloch<\/span>, Avocat Associ\u00e9, Droit Social<strong><em><br \/>\n<\/em><\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>&#8212;<\/p>\n<p>ref : <a href=\"https:\/\/www.legifrance.gouv.fr\/affichJuriJudi.do?oldAction=rechJuriJudi&amp;idTexte=JURITEXT000034215421&amp;fastReqId=694605371&amp;fastPos=1\" target=\"_blank\" rel=\"noopener noreferrer\">Cass.
