{"id":2109,"date":"2017-05-18T18:27:22","date_gmt":"2017-05-18T16:27:22","guid":{"rendered":"http:\/\/www.agilit.law\/?p=2109"},"modified":"2018-08-07T14:01:35","modified_gmt":"2018-08-07T12:01:35","slug":"plan-de-vigilance-societes-meres-entreprises-donneuses-d-ordre","status":"publish","type":"post","link":"https:\/\/www.agilit.law\/en\/droit-social-travail-securite-sociale\/plan-de-vigilance-societes-meres-entreprises-donneuses-d-ordre\/","title":{"rendered":"Nouveau plan de vigilance des soci\u00e9t\u00e9s m\u00e8res et des entreprises donneuses d\u2019ordre"},"content":{"rendered":"<p>La Loi n\u00b02017-399 du 27 mars 2017 introduit l&#8217;obligation pour les soci\u00e9t\u00e9s m\u00e8res et les entreprises donneuses d\u2019ordre de mettre en \u0153uvre un plan de vigilance vis \u00e0 vis de leurs filiales et sous-traitants.<\/p>\n<p><!--more--><\/p>\n<p>Suite au scandale du Rana Plaza en 2013, immeuble situ\u00e9 au Bangladesh qui a caus\u00e9 la mort de plus de 1.100 personnes en s\u2019effondrant, les pays europ\u00e9ens ont pris conscience des <strong>conditions de travail des sous-traitants<\/strong> des grands groupes europ\u00e9ens.<\/p>\n<p>C\u2019est dans ce contexte que s\u2019inscrit la loi n\u00b02017-399 du 27 mars 2017, instaurant, pour les soci\u00e9t\u00e9s fran\u00e7aises employant plus de 5.000 salari\u00e9s en France ou 10.000 salari\u00e9s dans le monde, en incluant leurs filiales, le devoir d\u2019\u00e9laborer, de rendre public et de mettre en \u0153uvre un nouveau <strong>plan de vigilance<\/strong>.<\/p>\n<h3>Les modalit\u00e9s du nouveau plan de vigilance<\/h3>\n<p>Celui-ci devra comporter des mesures propres \u00e0<strong> identifier les risques<\/strong> et \u00e0 <strong>pr\u00e9venir les atteintes aux droits humains et aux libert\u00e9s fondamentales<\/strong> qui pourraient r\u00e9sulter des activit\u00e9s de la soci\u00e9t\u00e9 m\u00e8re, des soci\u00e9t\u00e9s qu\u2019elle contr\u00f4le ainsi que des fournisseurs et sous-traitants avec lesquels elle entretient des relations commerciales \u00e9tablies.<\/p>\n<p>Ce plan de vigilance doit \u00eatre \u00e9labor\u00e9 afin d\u2019\u00eatre <strong>pr\u00e9sent\u00e9 \u00e0 l\u2019Assembl\u00e9e G\u00e9n\u00e9rale<\/strong> <strong>qui cl\u00f4ture l\u2019exercice 2017<\/strong>.
