On estime qu\u2019\u00e0 l\u2019heure actuelle, Gmail d\u00e9tient 43\u00a0% du march\u00e9 de la messagerie \u00e9lectronique<\/em>\u00a0\u00bb (https:\/\/www.frandroid.com\/android\/applications\/google-apps\/769329_gmail-google-tease-un-nouveau-logo).<\/p>\n<p>&nbsp;<\/p>\n<p>Ce changement de logo est l\u2019occasion de pr\u00e9senter succinctement l\u2019historique de la strat\u00e9gie de d\u00e9p\u00f4t de marque de GOOGLE pour sa messagerie phare.<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li><strong>La premi\u00e8re \u00e9tape\u00a0: le d\u00e9p\u00f4t de la marque verbale GMAIL (2004)<\/strong><\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>GOOGLE a tout d\u2019abord d\u00e9pos\u00e9 la marque verbale GMAIL aux Etats-Unis le 7 avril 2004 (<a href=\"https:\/\/tsdr.uspto.gov\/#caseNumber=78398233&amp;caseSearchType=US_APPLICATION&amp;caseType=SERIAL_NO&amp;searchType=statusSearch\">https:\/\/tsdr.uspto.gov\/#caseNumber=78398233&amp;caseSearchType=US_APPLICATION&amp;caseType=SERIAL_NO&amp;searchType=statusSearch<\/a>). Il est int\u00e9ressant de relever que la marque n\u2019a \u00e9t\u00e9 d\u00e9pos\u00e9e que pour les services de courrier \u00e9lectroniques (Electronic mail services) en classe 38.<\/p>\n<p>&nbsp;<\/p>\n<p>La marque a ensuite \u00e9t\u00e9 \u00e9tendue dans de nombreux pays \u00e0 travers le monde.<\/p>\n<p>GOOGLE a notamment essay\u00e9 de d\u00e9poser une marque communautaire\u00a0 mais trois oppositions ont \u00e9t\u00e9 d\u00e9pos\u00e9s devant l\u2019OHMI, notamment sur la base d\u2019une marque allemande ant\u00e9rieure<a href=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Marque-DE-Google.jpg\"><img decoding=\"async\" loading=\"lazy\" class=\"alignnone size-full wp-image-1213\" src=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Marque-DE-Google.jpg\" alt=\"Marque DE Google\" width=\"66\" height=\"44\" \/><\/a> en classe 38 (https:\/\/register.dpma.de\/DPMAregister\/marke\/register\/300256973\/DE), d\u2019un droit non-enregistr\u00e9e exploit\u00e9 au Royaume-Uni, et d\u2019une marque communautaire G-MAIL en classe 38 (elle-m\u00eame objet d\u2019une opposition sur la base de la marque allemande pr\u00e9cit\u00e9e).<\/p>\n<p>Le 26 f\u00e9vrier 2008, la chambre de recours de l\u2019OHMI a confirm\u00e9 le bien-fond\u00e9 de l\u2019opposition sur la base de la marque allemande <a href=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Marque-DE-Google.jpg\"><img decoding=\"async\" loading=\"lazy\" class=\"alignnone size-full wp-image-1213\" src=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Marque-DE-Google.jpg\" alt=\"Marque DE Google\" width=\"66\" height=\"44\" \/><\/a>\u00a0(d\u00e9cision R 252\/2007-2) et rejet\u00e9 la demande de marque de GOOGLE.<\/p>\n<p>Suite \u00e0 cette d\u00e9cision, GOOGLE a finalement retir\u00e9 sa demande de marque communautaire en avril 2008. Comme l\u2019opposition n\u2019\u00e9tait fond\u00e9e que sur une marque allemande, GOOGLE a ensuite transform\u00e9 sa demande de marque communautaire en marques nationales dans l\u2019ensemble des pays de l\u2019Union Europ\u00e9enne sauf en Allemagne.<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"2\">\n<li><strong>La deuxi\u00e8me \u00e9tape\u00a0: le d\u00e9p\u00f4t semi-figuratif <a href=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Depot-semi-fig-Google.jpg\"><img decoding=\"async\" loading=\"lazy\" class=\"alignnone wp-image-1214\" src=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Depot-semi-fig-Google.jpg\" alt=\"D\u00e9p\u00f4t semi-fig Google\" width=\"169\" height=\"60\" \/><\/a> <\/strong><strong>(2007)<\/strong><\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>Pour essayer de contourner ses d\u00e9boires concernant sa marque verbale, GOOGLE a d\u00e9pos\u00e9 en Union Europ\u00e9enne, le 13 f\u00e9vrier 2007, la demande de marque communautaire semi-figurative <a href=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Depot-semi-fig-Google.jpg\"><img decoding=\"async\" loading=\"lazy\" class=\"alignnone wp-image-1214\" src=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Depot-semi-fig-Google.jpg\" alt=\"D\u00e9p\u00f4t semi-fig Google\" width=\"79\" height=\"28\" \/><\/a>\u00a0en classes 9, 38 et 42 (<a href=\"https:\/\/euipo.europa.eu\/eSearch\/#details\/trademarks\/005685136\">https:\/\/euipo.europa.eu\/eSearch\/#details\/trademarks\/005685136<\/a>).<\/p>\n<p>&nbsp;<\/p>\n<p>Le titulaire de la marque allemande \u00a0<a href=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Marque-DE-Google.jpg\"><img decoding=\"async\" loading=\"lazy\" class=\"alignnone size-full wp-image-1213\" src=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Marque-DE-Google.jpg\" alt=\"Marque DE Google\" width=\"66\" height=\"44\" \/><\/a>a de nouveau form\u00e9 opposition (en invoquant \u00e9galement une marque allemande verbale G-MAIL). Par d\u00e9cision du 8 septembre 2010, la chambre de recours a confirm\u00e9 le bien-fond\u00e9 de l\u2019opposition en raison du risque de confusion entre les signes (d\u00e9cision R 342\/2010-4).<\/p>\n<p>Selon les \u00e9l\u00e9ments accessibles sur la base de l\u2019EUIPO, un accord a finalement \u00e9t\u00e9 conclu entre les parties d\u00e9but 2012, ce qui a permis l\u2019enregistrement de la marque communautaire <a href=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Depot-semi-fig-Google.jpg\"><img decoding=\"async\" loading=\"lazy\" class=\"alignnone wp-image-1214\" src=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Depot-semi-fig-Google.jpg\" alt=\"D\u00e9p\u00f4t semi-fig Google\" width=\"121\" height=\"43\" \/><\/a>.<\/p>\n<p>&nbsp;<\/p>\n<p>Suite \u00e0 cet accord, la marque semi-figurative a \u00e9t\u00e9 d\u00e9pos\u00e9e aux Etats-Unis puis dans de nombreux pays \u00e0 travers le monde.<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"3\">\n<li><strong>La troisi\u00e8me \u00e9tape\u00a0: le logo\u00a0<a href=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Logo-Google-NB.png\"><img decoding=\"async\" loading=\"lazy\" class=\"alignnone size-full wp-image-1215\" src=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Logo-Google-NB.png\" alt=\"Logo Google NB\" width=\"55\" height=\"40\" \/><\/a> <\/strong><strong>(2011)<\/strong><\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>Retour aux Etats-Unis o\u00f9 GOOGLE a d\u00e9pos\u00e9, le 19 avril 2011, une marque figurative sur le nouveau logo de sa messagerie repr\u00e9sentant une enveloppe formant un M.<\/p>\n<p>Deux \u00e9l\u00e9ments sont int\u00e9ressants dans ces d\u00e9p\u00f4ts\u00a0:<\/p>\n<ul>\n<li>Le libell\u00e9 est \u00e0 nouveau tr\u00e8s limit\u00e9\u00a0: \u00ab\u00a0<em>Electronic mail services for data and voice; instant messaging services; provision of video conferencing services [; text messaging services]\u201d <\/em>(classe 38)<\/li>\n<li>Le logo n\u2019est pas d\u00e9pos\u00e9 avec le M en couleur rouge (tel qu\u2019exploit\u00e9) mais en noir et blanc. Ce choix permet \u00e0 GOOGLE d\u2019obtenir un champ de protection plus large du logo, ind\u00e9pendamment de la couleur du M.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>La marque a ensuite \u00e9t\u00e9 \u00e9tendue dans de nombreux pays, soit par des d\u00e9p\u00f4ts nationaux directs, soit par le biais du d\u00e9p\u00f4t international n\u00b0 <a href=\"https:\/\/www.tmdn.org\/tmview\/#\/tmview\/detail\/WO500000001064622\">1064622<\/a>. GOOGLE n\u2019a rencontr\u00e9 aucun probl\u00e8me majeur pour ce d\u00e9p\u00f4t qui a \u00e9t\u00e9 enregistr\u00e9 en Union Europ\u00e9enne sans difficult\u00e9s.<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"4\">\n<li><strong>La quatri\u00e8me \u00e9tape\u00a0: le nouveau logo <a href=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Nouveau-logo-Google.png\"><img decoding=\"async\" loading=\"lazy\" class=\"alignnone size-full wp-image-1212\" src=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Nouveau-logo-Google.png\" alt=\"Nouveau logo Google\" width=\"59\" height=\"44\" \/><\/a> <\/strong><strong>(2020)<\/strong><\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>GOOGLE a d\u00e9pos\u00e9, le 5 octobre 2020, la demande de marque <a href=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Nouveau-logo-Google.png\"><img decoding=\"async\" loading=\"lazy\" class=\"alignnone size-full wp-image-1212\" src=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Nouveau-logo-Google.png\" alt=\"Nouveau logo Google\" width=\"59\" height=\"44\" \/><\/a>\u00a0aux Etats-Unis (<a href=\"https:\/\/tsdr.uspto.gov\/#caseNumber=90234979&amp;caseType=SERIAL_NO&amp;searchType=statusSearch\">https:\/\/tsdr.uspto.gov\/#caseNumber=90234979&amp;caseType=SERIAL_NO&amp;searchType=statusSearch<\/a>) pour des produits et services limit\u00e9s\u00a0: \u00ab\u00a0<em>Downloadable computer software for providing electronic mail services<\/em>\u00a0\u00bb (classe 9) et \u00ab\u00a0<em>Electronic mail services<\/em>\u00a0\u00bb (classe 38). GOOGLE a donc attendu la veille du lancement de son logo pour d\u00e9poser sa demande de marque.<\/p>\n<p>La demande n\u2019a \u00e0 ce jour \u00e9t\u00e9 \u00e9tendue qu\u2019en Argentine et au Chili, pays qui ne peuvent pas \u00eatre d\u00e9sign\u00e9s par un d\u00e9p\u00f4t international.<\/p>\n<p>Le lecteur non-sp\u00e9cialiste du droit des marques pourrait \u00eatre surpris que le nouveau logo soit lanc\u00e9 en Europe sans y \u00eatre prot\u00e9g\u00e9. Or, il n\u2019y a rien d\u2019\u00e9tonnant puisque l\u2019article 4 de la Convention d\u2019Union de Paris permet \u00e0 tout d\u00e9posant de b\u00e9n\u00e9ficier d\u2019un droit de priorit\u00e9 de six mois pour \u00e9tendre sa marque \u00e0 l\u2019\u00e9tranger en b\u00e9n\u00e9ficiant de la date initiale. GOOGLE dispose donc d\u2019un d\u00e9lai jusqu\u2019au 5 avril 2021 pour prot\u00e9ger son nouveau logo \u00e0 l\u2019\u00e9tranger en b\u00e9n\u00e9ficiant de la date du 5 octobre 2020.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>En conclusion, ce rapide historique des d\u00e9p\u00f4ts de GOOGLE concernant GMAIL permet de tirer certains enseignements\u00a0:<\/p>\n<ul>\n<li>Lorsqu\u2019un d\u00e9p\u00f4t est envisag\u00e9 dans de nombreux pays, il est extr\u00eamement difficile d\u2019\u00e9viter des droits ant\u00e9rieurs dans un ou plusieurs pays (ici, le d\u00e9p\u00f4t ant\u00e9rieur en Allemagne a caus\u00e9 des probl\u00e8mes \u00e0 Google pendant des ann\u00e9es)<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li>Le choix d\u2019un signe semi-figuratif peut limiter les risques de conflit par rapport aux droits ant\u00e9rieurs (m\u00eame si cela n\u2019a pas r\u00e9ellement fonctionn\u00e9 pour GOOGLE avec le signe <a href=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Depot-semi-fig-Google.jpg\"><img decoding=\"async\" loading=\"lazy\" class=\"alignnone wp-image-1214\" src=\"https:\/\/www.agilit.law\/wp-content\/uploads\/2021\/04\/Depot-semi-fig-Google.jpg\" alt=\"D\u00e9p\u00f4t semi-fig Google\" width=\"135\" height=\"48\" \/><\/a>)<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li>Il n\u2019est pas n\u00e9cessaire d\u2019avoir un libell\u00e9 trop large lorsque le produit ou le service est sp\u00e9cifique.
